{"id":974250,"date":"2020-01-03T13:05:10","date_gmt":"2020-01-03T20:05:10","guid":{"rendered":"https:\/\/www.rollingstone.com\/?p=915083"},"modified":"2020-01-03T13:05:10","modified_gmt":"2020-01-03T20:05:10","slug":"michael-jackson-accusers-can-now-sue-for-sexual-abuse","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/kfmu\/music-news\/michael-jackson-accusers-can-now-sue-for-sexual-abuse\/","title":{"rendered":"Michael Jackson Accusers Can Now Sue for Sexual Abuse"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/www.rollingstone.com\/wp-content\/uploads\/2019\/11\/MichaelJackson.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p class=\"p1\">Thanks to a new law, Wade Robson and James Safechuck \u2014 two men who have accused <a href=\"https:\/\/www.rollingstone.com\/t\/michael-jackson\/\" id=\"auto-tag_michael-jackson\" data-tag=\"michael-jackson\">Michael Jackson<\/a> of sexually abusing them when they were children \u2014 will get the chance to sue two corporate entities tied to the Jackson estate.<\/p>\n<p class=\"p2\">On January 1st a <a href=\"https:\/\/apnews.com\/1ce56c5dc248457ba6c1d1aedf4818da\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">new California law<\/a> went into effect that allows victims of childhood sexual abuse until the age of 40 (up from 26) to file civil lawsuits. The new law also extended the statute of limitations on a provision that stated victims could sue a third-party entities tied to the alleged abuser that either knew, or should have known, that abuse was happening, or failed to take reasonable steps to prevent the abuse.<\/p>\n<p class=\"p2\">\u201cThe corporations do not dispute these revisions apply to plaintiffs\u2019 nonfatal cases still pending on appeal, rendering their claims timely,\u201d the ruling read. \u201cWe agree and find their dispute under the previous statutory provisions to be moot.\u201d<\/p>\n<p class=\"p2\">Given this new law, on Friday a California appeals court overturned a <a href=\"https:\/\/apnews.com\/1ce56c5dc248457ba6c1d1aedf4818da\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">2017 ruling<\/a> that stated Robson and Safechuck couldn\u2019t sue MJJ Productions, Inc. or MJJ Ventures, Inc. because the suits hadn\u2019t been filed within the statute of limitations \u2014 and because neither entity could be held liable for Jackson\u2019s alleged actions.<\/p>\n<p> <!-- .l-article-content__pull--left --> <\/p>\n<p class=\"p2\">Vince Finaldi, a lawyer for Robson and Safechuck, tells <i>Rolling Stone<\/i>, \u201cWe\u2019re pleased the appellate court has affirmed the strong protections that California has for sexual abuse victims and recognized the extended statute of limitations that it provides.\u201d<\/p>\n<div class=\"pmc-contextual-player\">\n<h3> Popular on Rolling Stone <\/h3>\n<\/p><\/div>\n<p class=\"p2\">A representative for the Michael Jackson estate did not immediately return <i>Rolling Stone<\/i>\u2018s request for comment.<\/p>\n<p class=\"p1\">Robson and Safechuck detailed their accusations against Jackson in the <a href=\"https:\/\/www.rollingstone.com\/movies\/movie-news\/michael-jackson-sexual-abuse-documentary-sundance-776934\/\">HBO documentary <i><a href=\"https:\/\/www.rollingstone.com\/t\/leaving-neverland\/\" id=\"auto-tag_leaving-neverland\" data-tag=\"leaving-neverland\">Leaving Neverland<\/a><\/i><\/a>, although their legal battle with the Jackson estate began when they <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/michael-jackson-estate-denies-new-molestation-accusations-81475\/\">filed their first lawsuits<\/a> in 2013. <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/michael-jackson-molestation-lawsuit-dismissed-75367\/\">Two years later<\/a>, however, the Jackson estate was bumped from the suit, leaving, MJJ Productions, Inc. and MJJ Ventures, Inc. as defendants. Then, in 2017, a <a href=\"https:\/\/apnews.com\/1ce56c5dc248457ba6c1d1aedf4818da\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">judge dismissed<\/a> those suits under the old law governing the statute of limitations in regards to childhood sexual abuse cases.<\/p>\n<p class=\"p1\">The Jackson estate and <a href=\"https:\/\/www.rollingstone.com\/music\/music-features\/michael-jackson-family-estate-leaving-neverland-doc-801258\/\">Jackson\u2019s family<\/a> have repeatedly rebuffed Robson and Safechuck\u2019s allegations throughout the legal battle and leading up to the premiere of <i>Leaving Neverland<\/i>. For instance, they\u2019ve highlighted on numerous occasions that Robson testified that Jackson never molested him at the pop star\u2019s 2005 criminal trial, and that Safechuck similarly told authorities that Jackson never abused him.<\/p>\n<p class=\"p1\">In an <a href=\"https:\/\/www.rollingstone.com\/music\/music-features\/leaving-neverland-michael-jackson-accusers-wade-robson-james-safechuck-801830\/\">interview with <i>Rolling Stone<\/i><\/a>, Robson addressed the ostensible contradictions in his story and Safechuck\u2019s, their past support for Jackson and the reason it took them both so long to personally come to grips with the abuse they allegedly suffered and then come forward with it.<\/p>\n<p class=\"p1\">\u201cThis is one of the things they keep doing,\u201d he said of the Jackson estate, \u201ctaking one tiny piece and taking it out of context and using it as some sort of excuse or accusation. And there\u2019s a whole truth and story behind each one of these tiny things that when you take the time to understand all the complexity and all of the conflicting feelings. . . .
