{"id":975727,"date":"2020-03-18T07:44:41","date_gmt":"2020-03-18T13:44:41","guid":{"rendered":"https:\/\/www.rollingstone.com\/?p=969009"},"modified":"2020-03-18T07:44:41","modified_gmt":"2020-03-18T13:44:41","slug":"katy-perry-wins-appeal-in-dark-horse-infringement-case","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/kfmu\/music-news\/katy-perry-wins-appeal-in-dark-horse-infringement-case\/","title":{"rendered":"Katy Perry Wins Appeal in \u2018Dark Horse\u2019 Infringement Case"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/www.rollingstone.com\/wp-content\/uploads\/2020\/03\/shutterstock_editorial_10579792l.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p class=\"p1\"><a href=\"https:\/\/www.rollingstone.com\/t\/katy-perry\/\" id=\"auto-tag_katy-perry\" data-tag=\"katy-perry\">Katy Perry<\/a> has won <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/katy-perry-appeal-dark-horse-plagiarism-trial-899175\/\">her appeal<\/a> in the ongoing plagiarism dispute over her 2013 hit \u201cDark Horse.\u201d<\/p>\n<p class=\"p1\">In 2014, the pop star was sued by the Christian rapper Flame (real name Marcus Gray), who claimed Perry and others pulled an eight-note musical phrase (known as an ostinato) from his song \u201cJoyful Noise.\u201d Last July, a <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/katy-perry-dark-horse-lawsuit-flame-865058\/\">jury found in favor of Flame<\/a> and awarded him $2.8 million in damages.<\/p>\n<p class=\"p1\">In a new decision, however, U.S. District Judge Christina A. Snyder ruled that none of the individual elements that comprised the ostinato in \u201cJoyful Noise\u201d are \u201cindependently protectable\u201d under <a href=\"https:\/\/www.rollingstone.com\/t\/copyright\/\" id=\"auto-tag_copyright\" data-tag=\"copyright\">copyright<\/a> law, nor is the specific combination of them in his song.<\/p>\n<p class=\"p1\">\u201cIt is undisputed in this case, even viewing the evidence in the light most favorable to plaintiffs, that the signature elements of the eight-note ostinato in \u2018Joyful Noise\u2019\u2026 is not a particularly unique or rare combination, even in its deployment as an ostinato,\u201d Snyder wrote. \u201c[P]rior compositions, including prior works composed by the parties, as well as what all agree is a separate non-infringing ostinato in \u2018Dark Horse,\u2019 all contain similar elements.\u201d<\/p>\n<p> <!-- .l-article-content__pull--left --> <\/p>\n<p class=\"p1\">Per <a href=\"https:\/\/apnews.com\/c1f74039c73ea11888fe7ef8451491cc\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><i>The Associated Press<\/i><\/a>, Gray plans to appeal the latest ruling, with his lawyer Michael. A. Kahn saying, \u201cWhen the jurors returned a unanimous verdict of infringement, I cautioned my clients that we had only finished Round 11 of a 15-round match and that the next round would take place in the court of appeals. We believe the jury was right and will do our best to restore their verdict on appeal.\u201d<\/p>\n<p class=\"p1\">A lawyer for Perry, Christine Lepera, praised the ruling (via <a href=\"https:\/\/variety.com\/2020\/music\/news\/katy-perry-dark-horse-reversal-1203537482\/\" target=\"_blank\" rel=\"noopener noreferrer\"><i>Variety<\/i><\/a>): \u201cIn a well reasoned and methodical decision, the court properly vacated the jury verdict, finding that \u2018Dark Horse\u2019 does not infringe \u2018Joyful Noise,\u2019 as a matter of law. This an important victory for music creators and the music industry, recognizing that music building blocks cannot be monopolized. The creators of \u2018Dark Horse\u2019 stand vindicated.\u201d<\/p>\n<p class=\"p1\">The decision in favor of Perry marks the second big copyright win for artists this month, and potentially signals a reversal in how these cases will be tried and judged following the <a href=\"https:\/\/www.rollingstone.com\/music\/music-features\/beyond-blurred-lines-how-forensic-musicology-is-altering-pops-future-204986\/\">landmark \u201cBlurred Lines\u201d decision<\/a>.
