Mack reportedly pleaded not guilty.<\/p>\n<p>Mack&#8217;s attorneys filed a motion to dismiss the indictment against her on Friday, Dec. 28. According to court documents obtained by E! News, her team is seeking to &#8220;dismiss the four counts brought against her\u00a0 because those charges lack specificity, fail to state a claim under the applicable statutes, and are\u00a0unconstitutionally vague as applied to her alleged conduct.&#8221;<\/p>\n<p>In the court document, the former\u00a0<em>Smallville<\/em> actress&#8217; attorneys cited various court cases to prove their points, including one involving the famed church.<\/p>\n<\/section>\n<\/div>\n<div id=\"text-2\" data-hook=\"scrollable-block\" readability=\"56.5\">\n<section data-textblock-tracking=\"text-block-text-only\" data-swiftype-index=\"false\" readability=\"3\">\n<p>Her legal team referred to a case called\u00a0<em>Headley v. Church of Scientology Int&#8217;l<\/em>\u00a0in relation to her forced labor charges. They focus specifically on the idea of &#8220;serious harm.&#8221;<\/p>\n<\/section>\n<\/div>\n<div id=\"text-3\" data-hook=\"scrollable-block\" readability=\"64.5\">\n<section data-textblock-tracking=\"text-block-text-only\" data-swiftype-index=\"false\" readability=\"19\">\n<p>&#8220;The government argues that Ms. Mack obtained forced labor through &#8216;threats of serious harm,&#8217; with serious harm being the embarrassment that would result from the exposure of one&#8217;s\u00a0collateral,&#8221; the court document said. &#8220;Courts have found, however, that such an outcome, albeit embarrassing, does not\u00a0amount to serious harm under the statute.&#8221;<\/p>\n<p>Here&#8217;s where Scientology comes in. In the <em>Headley v. Church of Scientology Int&#8217;l<\/em>\u00a0case, &#8220;the court did\u00a0not find that plaintiffs were compelled to remain in the organization even though, if they chose to\u00a0 leave, they would be &#8216;excommunicated&#8217; from their friends and family and labeled a &#8216;dissenter.'&#8221;<\/p>\n<\/section>\n<\/div>\n<div id=\"block-4-img\" data-hook=\"scrollable-block\" data-swiftype-index=\"false\" readability=\"31\">\n<div class=\"post-content__image\" readability=\"32\"><img decoding=\"async\" class=\"image--full\" src=\"https:\/\/akns-images.eonline.com\/eol_images\/Entire_Site\/2018320\/rs_1024x759-180420123937-1024-Allison-Mack-red-carpet.jpg?fit=inside|900:auto&amp;output-quality=90\" border=\"0\" title=\"Allison Mack\" alt=\"Allison Mack\" data-width=\"1024\" data-height=\"759\"\/><\/p>\n<p class=\"image__credits\">Dimitrios Kambouris\/Getty Images<\/p>\n<\/div>\n<\/div>\n<div id=\"photo-txt-4\" data-hook=\"scrollable-block\" readability=\"36\">\n<section data-textblock-tracking=\"text-block-photo-text\" readability=\"12\">\n<p>Her attorneys added, &#8220;The threat of reputational damage and isolation from loved ones therefore did not qualify as serious harm.&#8221;<\/p>\n<p>Mack&#8217;s legal team is hoping to have the forced labor charge dropped\u00a0due to failure to state a claim. They argue Mack &#8220;allegedly required personal favors in the context of a club or society membership, and never knowingly obtained or provided &#8216;labor or services'&#8221; that were prohibited in the Thirteenth Amendment (i.e. &#8220;instances of forced (i) prostitution, (ii) sweatshop work, and\u00a0(iii) domestic service.&#8221;<\/p>\n<\/section>\n<\/div>\n<div id=\"text-5\" data-hook=\"scrollable-block\" readability=\"66\">\n<section data-textblock-tracking=\"text-block-text-only\" data-swiftype-index=\"false\" readability=\"22\">\n<p>When she was first arrested and charged with sex trafficking, U.S. Attorney\u00a0<strong>Richard Donoghue<\/strong> said in a statement, &#8220;As alleged in the indictment, Allison Mack recruited women to join what was purported to be a female mentorship group that was, in fact, created and led by Keith Raniere.&#8221;<\/p>\n<p>He added, &#8220;The victims were then exploited, both sexually and for their labor, to the defendants&#8217; benefit.&#8221;<\/p>\n<p>According to the U.S. Attorney&#8217;s office, there were parts of NXIVM that included female &#8220;slaves&#8221; and &#8220;masters.&#8221; These &#8220;slaves&#8221; were allegedly branded and purportedly forced to engage in sexual activities with Raniere in exchange for money.<\/p>\n<p>Mack&#8217;s alleged time in NXIVM occurred between February 2016 and June 2017.<\/p>\n<\/section>\n<\/div>\n<p><a href=\"https:\/\/www.eonline.com\/news\/1000253\/allison-mack-uses-the-church-of-scientology-as-part-of-her-defense-in-nxivm-case?cmpid=rss-000000-rssfeed-365-topstories&#038;utm_source=eonline&#038;utm_medium=rssfeeds&#038;utm_campaign=rss_topstories\" target=\"_blank\">via:: E!
