{"id":291761,"date":"2020-05-01T08:15:18","date_gmt":"2020-05-01T14:15:18","guid":{"rendered":"http:\/\/b1147065"},"modified":"2020-05-01T08:15:18","modified_gmt":"2020-05-01T14:15:18","slug":"meghan-markles-privacy-lawsuit-judge-strikes-out-some-claims-in-case","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/kidn\/music-news\/meghan-markles-privacy-lawsuit-judge-strikes-out-some-claims-in-case\/","title":{"rendered":"Meghan Markle&#8217;s Privacy Lawsuit: Judge Strikes Out Some Claims in Case"},"content":{"rendered":"<div id=\"video-int-txt-0\" data-hook=\"scrollable-block\" readability=\"42.334788937409\">\n<section data-textblock-tracking=\"text-block-video-text\" data-swiftype-index=\"false\" readability=\"26.940320232897\">\n<p>A <a href=\"https:\/\/www.eonline.com\/news\/1144562\/meghan-markle-says-her-dad-was-exploited-by-the-press-as-privacy-case-begins?query=meghan\" target=\"_blank\" rel=\"noopener noreferrer\">week into<\/a> <strong><a href=\"https:\/\/www.eonline.com\/news\/meghan_markle\">Meghan Markle<\/a><\/strong>&#8216;s privacy lawsuit, a judge has issued a ruling in favor of Associated Newspapers.&nbsp;<\/p>\n<p>As the Duchess of Sussex&#8217;s lawsuit against Associated Newspapers, the publisher of&nbsp;<em>Mail on Sunday<\/em>, gets underway over their&nbsp;<a href=\"https:\/\/www.eonline.com\/news\/1084434\/meghan-markle-s-private-letter-to-estranged-father-written-at-time-of-great-personal-anguish\" target=\"_blank\" rel=\"noopener noreferrer\">publishing of a private letter<\/a> to her father, Justice Warby ruled to strike out several claims&nbsp;in response to a pre-trial application from the defendant.&nbsp;<\/p>\n<p>According to a summary released on May 1, Associated Newspapers targeted three elements of Markle&#8217;s case to be struck out: &#8220;allegations that (1) the defendant acted dishonestly, and in bad faith; (2) the defendant deliberately dug up or stirred up conflict between the claimant and her father; and (3) the claimant was distressed by the defendant&#8217;s &#8216;obvious agenda of publishing intrusive or offensive stories about [her] intended to portray her in a false and damaging light.&#8217; The grounds of attack on each aspect of the case are that the allegations are irrelevant in law, or inadequately particularized, or that it would be disproportionate to litigate the issues raised so that they should be excluded from the scope of the case on case management grounds.&#8221;<\/p>\n<p>Per the summary, the court agreed that the three categories should be struck out. However, it was noted that, despite the ruling, Markle can come back with an application for permission to make amendments to the complaint.<\/p>\n<\/section>\n<\/div>\n<div id=\"text-2\" data-hook=\"scrollable-block\" readability=\"61\">\n<section data-textblock-tracking=\"text-block-text-only\" data-swiftype-index=\"false\" readability=\"12\">\n<p>In&nbsp;response to the ruling, a spokesperson for Schillings, who are representing Markle, said in a statement,&nbsp;&#8220;Today&#8217;s ruling makes&nbsp;very&nbsp;clear that the&nbsp;core&nbsp;elements of this case do not change&nbsp;and will continue&nbsp;to move&nbsp;forward.&nbsp;The Duchess&#8217; rights were violated;&nbsp;the legal boundaries around privacy were&nbsp;crossed.&nbsp;As part of this&nbsp;process,&nbsp;the extremes&nbsp;to&nbsp;which&nbsp;<em>The&nbsp;Mail on Sunday<\/em> used&nbsp;distortive,&nbsp;manipulative, and dishonest&nbsp;tactics&nbsp;to target&nbsp;The Duchess of Sussex&nbsp;have been put on full display.&#8221;<\/p>\n<\/section>\n<\/div>\n<div id=\"photo-txt-3\" data-hook=\"scrollable-block\" readability=\"36.5\">\n<div class=\"column post-content__image--left post-content__image\" data-swiftype-index=\"false\" readability=\"32\"> <img decoding=\"async\" class=\"image--full\" src=\"https:\/\/akns-images.eonline.com\/eol_images\/Entire_Site\/20191010\/rs_634x1024-191110072726-634-Meghan-Markle-LT-111019-shutterstock_editorial_10470895t.jpg?fit=inside|900:auto&amp;output-quality=90\" title=\"Meghan Markle, Remembrance Day Service\" alt=\"Meghan Markle, Remembrance Day Service\"><\/p>\n<p class=\"image__credits\">DAVID HARTLEY\/Shutterstock<\/p>\n<\/p><\/div>\n<section data-textblock-tracking=\"text-block-photo-text\" readability=\"11\">\n<p>The statement continued,&nbsp;&#8220;Whilst the Judge recognizes that there is a&nbsp;claim for breach of privacy and copyright, we&nbsp;are surprised to see that his ruling suggests that dishonest behavior is not relevant. We feel honesty and integrity are at the core of what matters; or as it relates to the <em>Mail on Sunday<\/em> and Associated Newspapers, their lack thereof. Nonetheless, we respect the Judge&#8217;s decision as the strong case against Associated will continue to focus on the issue of a private, intimate and hand-written letter from a daughter to her father that was published by <em>The Mail on Sunday<\/em>.
