Kelly Hasn\u2019t Really Been \u2018Dropped\u2019 By Anyone in Music"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/www.rollingstone.com\/wp-content\/uploads\/2019\/01\/shutterstock_8468023kW1.jpg\" class=\"ff-og-image-inserted\"\/><\/div>\n<p>In the short time since Lifetime\u2019s release of a <a href=\"https:\/\/www.rollingstone.com\/tv\/tv-features\/surviving-r-kelly-lifetime-docuseries-review-774317\/\">bombshell documentary<\/a> detailing <a href=\"https:\/\/www.rollingstone.com\/t\/r-kelly\/\" id=\"auto-tag_r-kelly\" data-tag=\"r-kelly\">R. Kelly<\/a>\u2019s alleged years-long history of sexual assault, everything has changed for the R&amp;B singer \u2014 and nothing has.<\/p>\n<p>Around 20 million TV viewers watched the six-part series, titled\u00a0<em>Surviving R. Kelly<\/em>,\u00a0within the\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/surviving-r-kelly-sparks-debate-and-a-ratings-hit-11547144611?mod=article_inline\" target=\"_blank\" rel=\"noopener nofollow\">first week<\/a> of its January 3rd debut, according to the cable network. The film ruled headlines in global news outlets. It set social media utterly alight. And last Friday, reports began emerging that Sony, which owns R. Kelly\u2019s record label RCA Records, has finally \u2014 after <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/r-kelly-rca-records-silence-776460\/\">protests and pressure from music fans<\/a> as well as <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/lady-gaga-apologizes-collaborating-r-kelly-777030\/\">members of the industry<\/a> reached a sharp peak \u2014 come to an agreement with the singer to \u201cpart ways.\u201d RCA\u2019s website no longer includes Kelly on its artist roster, and while the record label has not returned any media requests for comment, one can assume his name won\u2019t appear there again.<\/p>\n<p>But what may seem like a major blow to Kelly\u2019s career, or at least a significant victory in the popular movement to diminish his influence, is actually neither.<\/p>\n<p>Though details of the split between Kelly and his label have not come to light, a record company letting go of an artist typically just means it won\u2019t release music from them in the future \u2014 yet both parties will continue to profit off of all past music releases as long as those releases are in distribution. It is unusual for splits to result in a label releasing the rights of a back catalog, which would cut off its revenue stream from that catalog, sources say.<\/p>\n<p>\u201cI don\u2019t know if anybody knows exactly what \u2018dropping R. Kelly\u2019 means. Presumably, Sony and RCA will continue to distribute his back catalog and the royalties will continue to flow as they were,\u201d Lisa Alter, a top music attorney who specializes in copyright law, tells\u00a0<em>Rolling Stone<\/em>. Moreover, the split may\u2019ve actually resulted in an unanticipated extra payout for Kelly: \u201cIf the label had a contractual obligation to release additional material and didn\u2019t want to do it, it might make a financial settlement with the artist, because otherwise they could be potentially sued by the artist for that loss of income,\u201d Alter says. The exact worth of those unreleased albums is a number negotiated between the two parties, and high-profile artists are rumored to have commanded payouts in the millions in the past.<\/p>\n<p>Kelly indeed had two albums left on his contract with RCA, according to Don Russell, an advisor and consultant for the artist, who tells\u00a0<em>Rolling Stone<\/em>\u00a0that several other record labels have said they\u2019re \u201c<a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/r-kelly-rca-sony-sever-ties-781238\/\">very interested<\/a>\u201d in working with Kelly. (<em>Rolling Stone<\/em> has not been able to independently verify these claims.) \u201cHe\u2019s ready for the next level of life, anyway. It makes sense for them to shake hands and say, \u2018This train has run its course and I wish you guys the best and let\u2019s move on,&#8217;\u201d Russell says.<\/p>\n<p>Asked if Kelly was planning any legal action against RCA and Sony, Russell added,\u00a0\u201cOur goal is not to go after anybody because he wants everybody to be happy.\u201d<\/p>\n<p>When approached about its relationship with R. Kelly, Universal Music Publishing Group \u2014 which, like RCA, has been home to the singer\u2019s catalog for decades on the publishing end \u2014 tells\u00a0<em>Rolling Stone<\/em> that it also no longer represents the singer. \u201cWe actually made the decision some time ago, dating back to last spring,\u201d says a spokesperson for UMPG. Its website shows no sign of creations by Kelly, other than <a href=\"https:\/\/www.umusicpub.com\/us\/Digital-Music-Library\/search\/r-kelly\/artist\" target=\"_blank\" rel=\"noopener nofollow\">a few joint works<\/a> he released with Jay-Z in 2002 and 2004.<\/p>\n<p>But to think that UMPG has really \u201csevered ties\u201d with the singer, as some reports have suggested over the weekend, would again be incorrect. While UMPG may not publicly represent Kelly on its songwriter roster, the company is still responsible for distributing his past work \u2014 which totals some 681 songs, according to the list registered with BMI, one of the major U.S. performing-rights organization that collects licensing fees for songwriters. UMPG, which has not responded to request for comment on the matter, acquired Kelly\u2019s catalog in 2007 when its parent Universal Music Group took over Zomba, the company that previously controlled the singer\u2019s copyrights.<\/p>\n<p>\u201cApparently, UMPG has simply dropped R. Kelly insofar as his new, yet-to-be-created music is concerned. That is significantly different than the characterization of the relationship in the recent press,\u201d Alter says. \u201cSince UMPG continues to own R. Kelly\u2019s catalog of existing compositions, it will presumably continue to publish those compositions, profit from the exploitation of the works and pay R. Kelly royalties pursuant to the underlying agreement.\u201d<\/p>\n<p>In a nutshell: Regardless of either major music company\u2019s recent PR move, R. Kelly is likely making exactly as much money as he was before \u2014 if not a lot more. In the era of physical or digital music purchases, a record label\u2019s or publisher\u2019s decision to not extend their relationship with an artist may\u2019ve caused a significant setback for them, because artists drew their money from the continued production of songs. But in the streaming age, it\u2019s every single listen \u2014 no purchase required \u2014 that counts toward profit.<\/p>\n<p>On the day Lifetime aired the finale of <em>Surviving R. Kelly,\u00a0<\/em>Kelly\u2019s back-catalog streams shot up as much as <a href=\"https:\/\/www.billboard.com\/articles\/columns\/chart-beat\/8492984\/r-kelly-docuseries-caused-gain-music\" target=\"_blank\" rel=\"noopener nofollow\">116 percent<\/a>\u00a0according to Nielsen, rising from 1.9 million on January 2nd to 4.3 million on January 3rd. Using a rough back-of-envelope calculation with the oft-cited rate of 0.0084 cents per Spotify stream, that\u2019s a boost of around $20,000 in a day. Kelly\u2019s streams during the three days of the documentary\u2019s airing also saw a 65 percent daily bump.<\/p>\n<p>It is fashionable now to condemn R. Kelly: Adding to the reckoning-that-wasn\u2019t, last week saw a <a href=\"https:\/\/www.rollingstone.com\/music\/music-features\/r-kelly-lady-gaga-chance-rapper-apology-777782\/\">slew of convenient apologies<\/a> from prominent musicians like Chance the Rapper, Phoenix and Lady Gaga, demonstrating remorse for collaborating with him or otherwise adding to his clout in the <a href=\"https:\/\/www.rollingstone.com\/t\/music-industry\/\" id=\"auto-tag_music-industry\" data-tag=\"music-industry\">music industry<\/a>. But as an accidental quirk of the streaming business model, all the negative press so far has ended up in a surge of money for the singer \u2014 so much so that, if he releases another album in the future, no matter under which record label or publisher, he\u2019s almost guaranteed to get even richer from the streams of curious listeners.<\/p>\n<p>It\u2019s a problem that Spotify foresaw last year when it tried to introduce a <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/spotifys-hateful-conduct-policy-is-officially-dead-628598\/\">hateful conduct content policy<\/a>, which was quickly repealed after people accused it of trying to be a moral police force; so far, though, the streaming service\u2019s move has proven the only one \u2014 of all other music companies \u2014 to be of substance rather than posturing.<\/p>\n<p>Kelly, who was indicted in 2002 for child pornography but acquitted in 2008, has repeatedly denied the charges brought forth by his numerous alleged victims.
