Zac Brown<\/a> has filed a lawsuit against Ryan Tedder<\/a> over their collaboration \u201cNowhere Left to Go,\u201d a song that featured on the country singer\u2019s recent solo album The Controversy<\/em><\/a> but was removed after the two artists tussled legally over the song\u2019s rights.<\/p>\n

When the surprise eight-song The Controversy<\/em> arrived digitally on September 27th, \u201cNowhere Left to Go\u201d served as the opening track. However, the song has subsequently been scrubbed from the digital release of the album, with its removal the crux of Brown\u2019s lawsuit that accuses Tedder of filing a false DMCA takedown notice. (As of this writing, the song is unavailable on Spotify, Tidal and Apple Music, among other streaming services.)<\/p>\n

In the complaint filed Thursday in a California district court and obtained by Rolling Stone<\/em>, Brown details the creation of \u201cNowhere Left to Go,\u201d which began in March 2018 when Tedder sent Brown \u201cpreviously recorded elements referred to as a \u2018start\u2019 (the \u2018Start\u2019), with the intention that the Start be incorporated or merged into inseparable or interdependent parts of a potential new musical composition written or co-written with Mr. Brown.\u201d<\/p>\n

Working with one of Tedder\u2019s engineers, Brown turned the \u201cStart\u201d into a demo alternatively titled \u201cDance on Me\u201d and \u201cNowhere to Go.\u201d \u201cIt was always understood and agreed that Mr. Brown had ultimate and sole control and discretion as to the elements to be included in, and the completion and Plaintiffs\u2019 release of, the Nowhere Left to Go recording and musical composition,\u201d the lawsuit claims.<\/p>\n

However, roughly five months later, Brown alleges that further attempts to work on \u201cNowhere Left to Go\u201d were rebuffed by Tedder, who he claims failed to follow through on Brown\u2019s repeated attempts to complete the track. Brown ultimately finished the track on his own in July 2019.<\/p>\n

A month before completion, after Brown sent Tedder a near-finished version of the track, the lawsuit claims that Tedder told Brown that \u201che did not realize that Mr. Brown was pursuing the completion of the Nowhere Left to Go recording\u201d and that Tedder instead gave \u201cthe Start\u201d to Diplo, who was using it to create a different song.<\/p>\n

The suit claims that Tedder\u2019s manager later asked Brown\u2019s manager on a pair of occasions to delay the release of \u201cNowhere Left to Go\u201d until after Diplo\u2019s song came out; Brown\u2019s manager declined, and \u201cNowhere Left to Go\u201d arrived with The Controversy<\/em> on September 27th. (A press release that accompanied the release of the album did not mention Tedder as a collaborator, while fellow producers Max Martin, Benny Blanco, Skrillex and Andrew Watt were named.)<\/p>\n

Soon after The Controversy<\/em>\u2018s digital-only release, Tedder \u2013 who has \u201ccopyright interest\u201d in the collaboration \u2013 allegedly issued a \u201cDMCA Takedown Notice of Infringement\u201d on \u201cNowhere Left to Go,\u201d briefly forcing the album\u2019s removal from streaming services; while the album was restored soon after, the song remains unavailable. (Reps for Brown and Tedder did not immediately reply to requests for comment. A rep for Diplo declined to comment.)<\/p>\n

In addition to seeking damages and demanding a jury trial, Brown\u2019s lawsuit also seeks the right to both reinsert \u201cNowhere Left to Go\u201d on the digital track list as well as include the song when The Controversy<\/em> is physically released on vinyl and CD.<\/p>\n
