Flame. The July verdict found that Perry and her team had copied aspects of their 2013 hit from a 2008 Christian rap song and held them liable for $2.78 million in damages.<\/p>\n<p>The appeal was filed in California on October 9th, <a href=\"https:\/\/variety.com\/2019\/music\/news\/katy-perry-dark-horse-appeals-plagiarism-judgment-1203367490\/\" target=\"_blank\" rel=\"noopener noreferrer\">according to <em>Variety<\/em><\/a>, and the defendants are asking for the courts to either overturn the original verdict or grant them a new trial. The appeal notes that \u201cthe legally unsupportable jury verdicts in this music copyright infringement case that are widely recognized within the music industry\u2014and beyond\u2014as a grave miscarriage of justice,\u201d adding, \u201cthe erroneous verdicts in this case and the precedent established thereby present serious harm to music creators and to the music industry as a whole.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p> <!-- .l-article-content__pull--left --> <\/p>\n<p>The appeal contests that Gray\u2019s song \u201cJoyful Noise\u201d received relatively low exposure, noting that most of its play occurred in Christian venues. \u201cNo reasonable factfinder could have concluded that<span class=\"Apple-converted-space\">&nbsp;\u2018<\/span>Joyful Noise\u2019 was so well-known that it could be reasonably inferred that Defendants heard it, particularly in this digital age of content overload, with billions of videos and songs available to users with trillions of streams,\u201d the appeal says. \u201cPlaintiffs had no proof that any of the \u2018Dark Horse\u2019 writers searched for Christian rap on YouTube or Myspace, as was Plaintiffs\u2019 burden.\u201d The full appeal is available <a href=\"https:\/\/www.scribd.com\/document\/430264834\/Katy-Perry-et-al-Appeal-Decision-in-Dark-Horse-Lawsuit\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">here<\/a>.<\/p>\n<p>In July, a nine-member federal jury in Los Angeles <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/katy-perry-dark-horse-lawsuit-flame-865058\/\">unanimously ruled<\/a> that Perry\u2019s 2013 hit single improperly copied \u201cJoyful Noise.\u201d Producers and songwriters <a href=\"https:\/\/www.rollingstone.com\/t\/dr-luke\/\" id=\"auto-tag_dr-luke\" data-tag=\"dr-luke\">Dr. Luke<\/a>, Max Martin, Cirkut, Sarah Hudson and <a href=\"https:\/\/www.rollingstone.com\/t\/juicy-j\/\" id=\"auto-tag_juicy-j\" data-tag=\"juicy-j\">Juicy J<\/a> were found liable alongside Perry, as were Capitol Records, Kobalt Publishing and Kasz Money. The plagiarism suit was brought by Gray and his two collaborators on \u201cJoyful Noise,\u201d Emanuel Lambert and Chike Ojukwuhis.
