{"id":20805,"date":"2020-01-02T15:30:34","date_gmt":"2020-01-02T22:30:34","guid":{"rendered":"https:\/\/www.skyhinews.com\/?p=62364"},"modified":"2020-01-03T13:07:04","modified_gmt":"2020-01-03T20:07:04","slug":"da-reviewing-investigation-into-kpd-chief-lucas-kremmling-in-limbo","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/krky\/local-news\/da-reviewing-investigation-into-kpd-chief-lucas-kremmling-in-limbo\/","title":{"rendered":"DA reviewing investigation into KPD Chief Lucas; Kremmling in limbo"},"content":{"rendered":"<figure class=\"wp-block-image p402_hide\">\n<div class=\"caption-container\"> <img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/cdn.skyhinews.com\/wp-content\/uploads\/sites\/9\/2020\/01\/KPDUpdate-shn-010320-1-1-1024x682.jpg\" class=\"attachment-large size-large wp-post-image\" alt srcset=\"https:\/\/cdn.skyhinews.com\/wp-content\/uploads\/sites\/9\/2020\/01\/KPDUpdate-shn-010320-1-1-1024x682.jpg 1024w, https:\/\/cdn.skyhinews.com\/wp-content\/uploads\/sites\/9\/2020\/01\/KPDUpdate-shn-010320-1-1-300x200.jpg 300w, https:\/\/cdn.skyhinews.com\/wp-content\/uploads\/sites\/9\/2020\/01\/KPDUpdate-shn-010320-1-1-768x512.jpg 768w, https:\/\/cdn.skyhinews.com\/wp-content\/uploads\/sites\/9\/2020\/01\/KPDUpdate-shn-010320-1-1-1536x1023.jpg 1536w, https:\/\/cdn.skyhinews.com\/wp-content\/uploads\/sites\/9\/2020\/01\/KPDUpdate-shn-010320-1-1-2048x1364.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"><figcaption><strong>Kremmling Police Chief Jamie Lucas reacts during a special town council meeting at Kremmling Town Hall in December.<\/strong><br \/><em>Eli Pace \/ epace@skyhinews.com<\/em><\/figcaption><\/div>\n<\/figure>\n<p>It could be up to four weeks before a decision is made whether to take action in the investigation of Kremmling Police Chief Jamie Lucas\u2019 handling of an animal cruelty case, said the 14th Judicial District Attorney\u2019s Office.<\/p>\n<p>District Attorney Matt Karzen said his office is reviewing the investigation of Lucas conducted by the Fraser Winter Park Police Department, and his office is working on a one to four week timeline.<\/p>\n<p>\u201cI think it\u2019s going to be closer to the two week range, but then we\u2019ll be in a position to make a decision, what if anything, we should do moving forward,\u201d Karzen said.<\/p>\n<p>The DA\u2019s office initiated an investigation of Lucas after receiving concerns from the Grand County Sheriff\u2019s Office that Lucas cited three juveniles into municipal court \u201cfor what appears to be a felony animal cruelty incident that occurred outside KPD\u2019s jurisdiction.\u201d Lucas did not return requests for comment.<\/p>\n<p>In December, Kremmling Town Council put Lucas on paid administrative leave after the town received a letter from the DA\u2019s office saying the office could no longer accept criminal cases from Chief Lucas, nor any cases that involve him in an investigative capacity.<\/p>\n<p>Kremmling Town Council was clear its decision to pull Lucas off the job for the time being doesn\u2019t reflect a lack of faith in him as council members voiced a desire to fight the DA\u2019s decision.<\/p>\n<p>\u201cMy take from the meeting is that, until we know anything else, we are in support (of Lucas) and the ultimate goal would be to have him return to work,\u201d Stoltman said.<\/p>\n<p>Aside from placing Lucas on leave, the town has not any taken action because, Stoltman explained, they are waiting for the DA\u2019s final decision.<\/p>\n<p>\u201cWe can\u2019t really do anything until the outcome of the investigation is completed and looked through by the DA\u2019s office,\u201d Stoltman said. \u201cOnce we have the outcome, we\u2019ll evaluate that and go from there, but I think we\u2019re in a kind of holding pattern until that time.\u201d<\/p>\n<p>The investigation stems from Lucas\u2019 alleged mishandling of a report of animal abuse, in which three juveniles were accused of mutilating and shooting a feral cat on a property outside town limits in October.<\/p>\n<p>The incident was reportedly caught on a video that was shared at West Grand High School before a tipster alerted authorities on Nov. 4. Chief Lucas previously said he handled the animal abuse investigation by charging the juveniles with disturbing the peace and fining them $500 through Kremmling\u2019s municipal court system without filing a police report.<\/p>\n<p>According to a statement from the DA\u2019s office, Lucas originally cited the juveniles for violating a Kremmling ordinance, despite the listed address for the offense being outside of town limits and beyond the jurisdiction of the Kremmling Municipal Court.<\/p>\n<p>The statement added that, after the Grand County Sheriff\u2019s Office brought its concerns about the jurisdiction to Lucas, he \u201camended the location of the offense on the citations he had issued to an address inside his jurisdiction.\u201d<\/p>\n<p>Kremmling Municipal Court Judge Ron Carlson, who had not seen the defendants in court, said that if he received a summons with an address listed outside his jurisdiction, he would not be able to prosecute it.<\/p>\n<p>\u201cI would probably have to dismiss it,\u201d Carlson said. \u201c(Jurisdiction) doesn\u2019t mean a person\u2019s residence, but it means where the event happened. You always have to establish venue and jurisdiction.\u201d<\/p>\n<p>Karzen said that, in his career, he has not seen another potential felony investigation without a police report.
