The material was then loaded and hauled off-site, the letter said.<\/p>\n<p>The county takes the failure to comply with seasonal restrictions seriously, Bower wrote, particularly since that was part of the <a href=\"https:\/\/www.postindependent.com\/news\/rmr-quarry-owners-sue-garfield-county-to-get-out-of-permit-violation-demands\/\">notice of violation<\/a> Garfield County commissioners issued in May 2019.&nbsp;<\/p>\n<p>\u201cThis repetitive disregard of County regulations cannot continue,\u201d Bower wrote.<\/p>\n<p>The Colorado Department of Reclamation and Mining Safety <a href=\"https:\/\/dnrweblink.state.co.us\/DRMS\/0\/edoc\/1299848\/2020-04-06_ENFORCEMENT%20-%20M1982121.pdf?searchid=b35cb027-ff8d-4fb8-aef6-1893677213fc\" target=\"_blank\" rel=\"noopener noreferrer\">wrote to RMI<\/a><i class=\"fas fa-external-link-alt\"><\/i> April 6 asking how the company would resolve the noncompliance issue. DRMS also asked for a \u201cstatus update of the ongoing litigation between RMR and Garfield County.\u201d<\/p>\n<p>After the notice of violation last year, RMI sued the county for acting capriciously and outside of its jurisdiction.
