{"id":794805,"date":"2019-04-14T09:44:01","date_gmt":"2019-04-14T15:44:01","guid":{"rendered":"https:\/\/www.summitdaily.com\/news\/aspen-cop-reinstated-after-threat-investigation\/"},"modified":"2019-04-14T09:44:01","modified_gmt":"2019-04-14T15:44:01","slug":"aspen-cop-reinstated-after-threat-investigation","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/ksmt\/local-news\/aspen-cop-reinstated-after-threat-investigation\/","title":{"rendered":"Aspen cop reinstated after threat investigation"},"content":{"rendered":"<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"443\" height=\"620\" src=\"https:\/\/cdn.summitdaily.com\/wp-content\/uploads\/sites\/2\/2019\/04\/copthreat-atd-041319.jpg\" class=\"attachment-large size-large wp-post-image\" alt srcset=\"https:\/\/cdn.summitdaily.com\/wp-content\/uploads\/sites\/2\/2019\/04\/copthreat-atd-041319.jpg 443w, https:\/\/cdn.summitdaily.com\/wp-content\/uploads\/sites\/2\/2019\/04\/copthreat-atd-041319-214x300.jpg 214w\" sizes=\"auto, (max-width: 443px) 100vw, 443px\"><\/figure>\n<p class=\"STND-STND BodyText\">An Aspen police officer accused by a teenager <a id=\"N0x298ef60N0x29f2790:N0x298ef60N0x2972330\" href=\"https:\/\/www.aspentimes.com\/news\/aspen-cop-placed-on-leave-during-investigation-into-alleged-threat-of-local-teen\/\">of threatening to kill him<\/a> last month will return to duty after the District Attorney\u2019s Office declined to file criminal charges against him, authorities said Friday.<\/p>\n<p class=\"STND-STND BodyText\">Officer Marcin Debski, whose conduct was vetted by the Colorado Bureau of Investigation, will face disciplinary measures, Aspen assistant police chief Bill Linn said, though he declined to specify what they are.<\/p>\n<p class=\"STND-STND BodyText\">In a phone interview Friday, Debski said he never threatened the teen and was only trying to protect his daughter from interacting with him.<\/p>\n<p class=\"STND-STND BodyText\">\u201cI sincerely apologize to the community as a whole and to the Aspen Police Department for my actions that did not live up to my standards,\u201d Debski said. \u201cMy intention is always to represent the department with integrity, and I\u2019m sorry not to have upheld that level of professionalism while on duty.\u201d<\/p>\n<p class=\"STND-STND BodyText\">The father of the teen, however, said he still believes Debski threatened his son, who offered to take a lie-detector test to prove he was telling the truth.<\/p>\n<p class=\"STND-STND BodyText\">\u201c(My son) deserves justice on this, and I think he\u2019s getting screwed,\u201d said the father, who is not being identified to avoid identifying his underage son. \u201cGiven APD\u2019s track record, I don\u2019t think much is going to happen (to Debski) after this.\u201d<\/p>\n<p class=\"STND-STND BodyText\">The 17-year-old at the center of the drama is involved in two recent drug- and alcohol-related cases investigated by Aspen police and the Pitkin County Sheriff\u2019s Office. One involves teens who allegedly <a id=\"N0x298ef60N0x29f2850:N0x298ef60N0x2972720\" href=\"https:\/\/www.aspentimes.com\/news\/teen-scheme-to-steal-aspen-hotel-booze-yields-felonies\/\">broke into a downtown hotel<\/a> Jan. 3 and stole alcohol, while the second, which grew out of the first, centers on an Aspen High School senior and his parents a<a id=\"N0x298ef60N0x29f28b0:N0x298ef60N0x29727b0\" href=\"https:\/\/www.aspentimes.com\/news\/cops-aspen-parents-gave-coke-to-minor\/\">ccused of giving alcohol, cocaine<\/a> and other drugs to minors.<\/p>\n<p class=\"STND-STND BodyText\">The 17-year-old is currently facing several felony charges in Pitkin County District Court related to the first case and others.<\/p>\n<p class=\"STND-STND BodyText\">As part of court-ordered supervision, the teen was at the Pitkin County Health and Human Services Building on March 22 taking a drug test when he said Debski spotted him in the lobby. Debski, who was armed and wearing his APD uniform, followed the young man to the bus stop and asked if he knew him, the teen told the Times in March.<\/p>\n<p class=\"STND-STND BodyText\">When the teenager said he didn\u2019t, Debski asked if he knew his daughter. The teen then asked her name and said he did know her. Debski told him he was speaking to him as a father and didn\u2019t want him talking to his daughter.<\/p>\n<p class=\"STND-STND BodyText\">\u201cThen he said, \u2018I know who you are and if you talk to her again, I will find out and I will f\u2014ing murder you,\u2019\u201d the teen said in a written statement submitted to the sheriff\u2019s office.<\/p>\n<p class=\"STND-STND BodyText\">Debski said Friday that the account is accurate, except for the threat, which he did not make.<\/p>\n<p class=\"STND-STND BodyText\">A CBI agent interviewed Debski, the teen and his father in the course of investigating the event, according to Debski and the father.<\/p>\n<p class=\"STND-STND BodyText\">In a letter Monday to the agent saying he wouldn\u2019t file charges against Debski, District Attorney Jeff Cheney said the \u201cevidence was consistent that Officer Debski was in uniform when he approached (name redacted) at the bus stop.\u201d<\/p>\n<p class=\"STND-STND BodyText\">\u201cMoreover, I am reasonably certain that Officer Debski told (redacted) to stay away from (redacted) and that he may have said, \u2018Stay the f\u2014 \u2026 away from (redacted),\u2019\u201d Cheney wrote in the letter, which APD released Friday.<\/p>\n<p class=\"STND-STND BodyText\">However, Cheney noted the teen told the CBI agent Debski never raised his voice, did not touch him and, while he spoke in a stern voice, remained calm, according to the letter.<\/p>\n<p class=\"STND-STND BodyText\">\u201cExcept for the assertion of (redacted) that Officer Debski threatened to kill him, there is no evidence sufficient to support a reasonable person to believe that Officer Debski did, in fact, make such a threat,\u201d Cheney wrote. \u201cDespite there being a number of potential witnesses, who would have overheard such a threat, no one corroborated (redacted) assertion.\u201d<\/p>\n<p class=\"STND-STND BodyText\">Finally, Debski\u2019s credibility was further enhanced when he adamantly insisted he didn\u2019t make the death threat despite being told by the agent of the presence of witnesses and the possibility of a recording, Cheney wrote.<\/p>\n<p class=\"STND-STND BodyText\">\u201cIn short, the evidence is insufficient to form probable cause that any criminal offense(s) occurred,\u201d Cheney concluded.<\/p>\n<p class=\"STND-STND BodyText\">The teen\u2019s father Friday said none of the witnesses at the bus stop on Castle Creek Road heard Debski because he was inches from his son\u2019s face and spoke quietly. Further, Debski had no professional reason to follow his son in the first place, he said.<\/p>\n<p class=\"STND-STND BodyText\">\u201c(Debski\u2019s) not part of the investigations (into his son),\u201d the father said. \u201c(My son) was doing what he was supposed to be doing. Why would he make contact with (my son) other than to make a threat?\u201d<\/p>\n<p class=\"STND-STND BodyText\">Debski said Friday the teen was never threatening toward his daughter, but declined to talk further about why he felt the need to speak to him that day.<\/p>\n<p class=\"STND-STND BodyText\">\u201cI shouldn\u2019t have done it in uniform,\u201d Debski said.<\/p>\n<p class=\"STND-STND BodyText\">Debski, who has been on administrative leave since March 22, said he will likely be back on patrol duty in the next couple weeks.<\/p>\n<p class=\"STND-STND BodyText\">\u201cIt\u2019s definitely a relief,\u201d he said of the end of the investigation.<\/p>\n<p class=\"STND-STND BodyText\">Aspen Police Chief Richard Pryor has said that up until the complaint from the teen, Debski\u2019s record with the department was \u201cexemplary.\u201d Debski was previously a Pitkin County sheriff\u2019s deputy.<\/p>\n<p class=\"STND-STND BodyText Tagline\"><a href=\"mailto:jauslander@aspentimes.com\">jauslander@aspentimes.com<\/a><\/p>\n<p><a href=\"https:\/\/www.summitdaily.com\/news\/regional\/aspen-cop-reinstated-after-threat-investigation\/\" target=\"_blank\" rel=\"noopener noreferrer\">via:: Summit Daily<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>An Aspen police officer accused by a teenager of threatening to kill him last month will return to duty after the District Attorney\u2019s Office declined to file criminal charges against him, authorities said Friday.
