{"id":801748,"date":"2019-11-25T15:55:12","date_gmt":"2019-11-25T22:55:12","guid":{"rendered":"https:\/\/www.summitdaily.com\/?p=375075"},"modified":"2019-11-25T15:55:12","modified_gmt":"2019-11-25T22:55:12","slug":"judge-denies-resentencing-for-man-who-assaulted-breckenridge-police-officer","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/ksmt\/local-news\/judge-denies-resentencing-for-man-who-assaulted-breckenridge-police-officer\/","title":{"rendered":"Judge denies resentencing for man who assaulted Breckenridge police officer"},"content":{"rendered":"<figure class=\"wp-block-image p402_hide\">\n<div class=\"caption-container\"> <img loading=\"lazy\" decoding=\"async\" width=\"418\" height=\"620\" src=\"https:\/\/cdn.summitdaily.com\/wp-content\/uploads\/sites\/2\/2019\/03\/BrfBreckAssault-SDN-072718.jpg\" class=\"attachment-large size-large wp-post-image\" alt srcset=\"https:\/\/cdn.summitdaily.com\/wp-content\/uploads\/sites\/2\/2019\/03\/BrfBreckAssault-SDN-072718.jpg 418w, https:\/\/cdn.summitdaily.com\/wp-content\/uploads\/sites\/2\/2019\/03\/BrfBreckAssault-SDN-072718-202x300.jpg 202w\" sizes=\"auto, (max-width: 418px) 100vw, 418px\"><figcaption><strong>Nathan Finnegan, 23, was sentenced to 13 years in prison for assaulting a Breckenridge police officer during an early morning confrontation last summer.<\/strong><br \/><em>Office of the District Attorney 5th District<\/em><\/figcaption><\/div>\n<\/figure>\n<p>BRECKENRIDGE \u2014 Chief Judge Mark Thompson on Monday sent a message to would-be assailants that attacks against police officers won\u2019t be taken lightly, choosing to reject a motion to reduce the sentence for Nathan Alexander Finnegan.<\/p>\n<p>Finnegan, 23, appeared in district court Monday morning hoping to get a reduction on the <a rel=\"noreferrer noopener\" aria-label=\"13 year Department of Corrections sentence (opens in a new tab)\" href=\"https:\/\/www.summitdaily.com\/news\/crime\/man-sentenced-to-13-years-in-prison-for-assault-on-breckenridge-officer\/\" target=\"_blank\">13-year Department of Corrections sentence<\/a> he received following a trial in March, when he was <a rel=\"noreferrer noopener\" aria-label=\"convicted on a charge of second-degree assault (opens in a new tab)\" href=\"https:\/\/www.summitdaily.com\/news\/man-found-guilty-of-assaulting-breckenridge-police-officer\/\" target=\"_blank\">convicted on a charge of second-degree assault<\/a> on a peace officer along with other crimes.<\/p>\n<p>In July 2018, Breckenridge Police Department officer Jennifer Kruse <a rel=\"noreferrer noopener\" aria-label=\"found Finnegan laying in the roadway of Highway 9 (opens in a new tab)\" href=\"https:\/\/www.summitdaily.com\/news\/crime\/trial-begins-for-man-accused-of-assaulting-breckenridge-police-officer\/\" target=\"_blank\">found Finnegan laying in the roadway of Colorado Highway 9<\/a> near the intersection with Highlands Drive. Finnegan was involved in a single-vehicle accident before he was found heavily inebriated on the road, and he later assaulted Kruse when she arrived to help him \u2014 an incident that left her with a large laceration on her face, severe bruising and a concussion.<\/p>\n<p>Following a four-day trial in March, Finnegan was convicted of second-degree assault of a peace officer, along with lesser charges of criminal mischief, resisting arrest, leaving the scene of an accident, careless driving and driving under the influence.<\/p>\n<p>In May, Thompson sentenced Finnegan to 13 years in prison and afforded him 290 days of time already served. At the hearing Monday, Finnegan and his attorney, J.B. Katz, motioned the court to reduce the sentence, noting achievements Finnegan already has made in his six months in prison, along with what Katz characterized as inconsistencies in the way the court sentenced similar cases.<\/p>\n<p>Katz was the first to speak, and pointed to another serious assault on a police officer from 2017, when <a rel=\"noreferrer noopener\" aria-label=\" James Morrow broke a Dillon Police officer\u2019s humerus (opens in a new tab)\" href=\"https:\/\/www.summitdaily.com\/news\/man-sentenced-to-4-years-in-prison-for-assaulting-dillon-police-officer\/\" target=\"_blank\">James Morrow broke a Dillon Police Department officer\u2019s humerus<\/a> and was sentenced to four years. Katz also said Finnegan\u2019s sentence was inhibiting his rehabilitation, in that he\u2019s been denied from numerous in-prison classes and programs designed primarily for individuals who are within five years of their release dates.<\/p>\n<p>Finnegan\u2019s mother, Lora Youngmark, spoke on her son\u2019s behalf at the hearing, noting the considerable impact his absence has had on the entire family since his incarceration and urging the judge to reduce his sentence.<\/p>\n<p>\u201cWe love Nathan,\u201d Youngmark said. \u201cYes, drugs and alcohol played a huge part in this. That\u2019s what most 21-year-olds are out doing these days, not knowing what the consequences could be. But there are a lot of programs out there that would help him more than sitting in prison and help him turn things around and make a huge impact.\u201d<\/p>\n<p>Finnegan also spoke for himself, saying he was \u201clost\u201d in his early life and willing to fit in wherever he could, including in groups heavily involved in drugs and alcohol. Finnegan also said he\u2019s been developing plans for his future through Defy Colorado \u2014 an entrepreneurship-based education program for inmates \u2014 including a podcast to reach out to other young people dealing with mental health and substance use issues similar to his.<\/p>\n<p>\u201cI\u2019d like to reference a statement: \u2018You need to go figure out if you\u2019re going to be a follower or leader,\u2019\u201d Finnegan said, referencing a remark made by Thompson during the original sentencing. \u201cI\u2019m a leader, not for anyone else, but for myself. I have initiatives for the future. \u2026 In the time since this incident, I\u2019ve become a different person. I hope you can see the changes I\u2019ve made within myself.\u201d<\/p>\n<p>Deputy District Attorney Stephanie Cava presented the argument for the prosecution, claiming that the court got the sentence right the first time, citing the significance of Kruse\u2019s injuries, Finnegan\u2019s prior criminal history and more.<\/p>\n<p>Lyn Herford, a sergeant with the Breckenridge Police Department who hired Kruse, said Finnegan shouldn\u2019t receive any further leniency for his crimes because Kruse likely won\u2019t ever fully recover from her injuries.<\/p>\n<p>\u201cFinnegan got sentenced to 13 years,\u201d Herford said. \u201cKruse is sentenced to a lifetime of those memories. Let\u2019s not forget that Kruse is the victim of this crime, and she has to live her entire life with the after effects of that night. \u2026 You said you were tired of the assaults on police officers in our community. The law enforcement community is also tired of those assaults.\u201d<\/p>\n<p>Ultimately Thompson wasn\u2019t swayed by Finnegan\u2019s arguments. He said Finnegan\u2019s assault wasn\u2019t comparable to Morrow\u2019s \u2014 noting Finnegan\u2019s attack was unprovoked. Thompson also commended Finnegan for his record so far in the Department of Corrections but said there was nothing that would compel him to change the sentence.<\/p>\n<p>\u201cThe kind of unprovoked attack, whether the result of drugs or alcohol or both, is extremely egregious and extremely dangerous,\u201d Thompson said. \u201cYou\u2019re rehabilitatable; you\u2019ve demonstrated that. But this sentence is a direct consequence of your conduct at the end of the day. And it is a harsh sentence in relative terms. But it was an extremely impactful crime on this community and on law enforcement.
