{"id":2441653,"date":"2019-03-13T00:00:00","date_gmt":"2019-03-13T06:00:00","guid":{"rendered":"https:\/\/www.aspentimes.com\/?p=301530"},"modified":"2019-03-13T00:00:00","modified_gmt":"2019-03-13T06:00:00","slug":"aspen-to-ask-voters-this-fall-to-keep-excess-tobacco-tax-revenue","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/kspn\/local-news\/aspen-to-ask-voters-this-fall-to-keep-excess-tobacco-tax-revenue\/","title":{"rendered":"Aspen to ask voters this fall to keep excess tobacco tax revenue"},"content":{"rendered":"<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"620\" height=\"413\" src=\"https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2019\/03\/bizcover-atd-030419-2.jpg\" class=\"attachment-large size-large wp-post-image\" alt srcset=\"https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2019\/03\/bizcover-atd-030419-2.jpg 620w, https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2019\/03\/bizcover-atd-030419-2-300x200.jpg 300w\" sizes=\"auto, (max-width: 620px) 100vw, 620px\"><\/figure>\n<p class=\"STND-STND BodyText\">The city of Aspen will ask voters this fall to authorize keeping <a id=\"N0x1199680N0x117d480:N0x1199680N0x11b5070\" href=\"https:\/\/www.aspentimes.com\/news\/local\/aspen-chews-on-tabor-after-surplus-from-new-tobacco-tax\/\">excess tax revenue<\/a> on tobacco products that the government collected last year.<\/p>\n<p class=\"STND-STND BodyText\">That was the direction Aspen City Council gave during a work session Tuesday when faced with what to do with an extra $111,622 that was collected over and above what was estimated as $325,000 in tax revenue for 2018.<\/p>\n<p class=\"STND-STND BodyText\">A new $3 tax was placed on a pack of cigarettes bought in Aspen \u2014 with a 10-cent increase annually until the tax reaches $4 \u2014 on Jan. 1, 2018. The tax also included a 40 percent hike on all other tobacco products including snuff, chewing tobacco, e-cigarettes and cigars.<\/p>\n<p class=\"STND-STND BodyText\">Because the tobacco tax revenue exceeded city projections by more than 33 percent, the state\u2019s Taxpayer Bill of Rights, which Coloradans approved in 1992, takes effect.<\/p>\n<p class=\"STND-STND BodyText\">City Finance Director Pete Strecker had originally <a id=\"N0x1199680N0x117d4e0:N0x1199680N0x11b5340\" href=\"http:\/\/aspen.siretechnologies.com\/SIREPub\/cache\/2\/fl4zkpvjqnfmancml3kifhek\/8446403122019031949935.PDF\">suggested<\/a> that the excess tobacco revenue be given back to residents via the city\u2019s <a id=\"N0x1199680N0x117d540:N0x1199680N0x11b53d0\" href=\"https:\/\/www.aspentimes.com\/news\/local\/aspen-food-tax-refund-to-increase-to-55\/\">food tax refund,<\/a> which is available to Aspen residents if they apply for it by April 15.<\/p>\n<p class=\"STND-STND BodyText\">But after researching TABOR restrictions, Strecker said the food tax refund isn\u2019t an option and would\u2019ve required the tax rate to be brought down.<\/p>\n<p class=\"STND-STND BodyText\">\u201cThis wasn\u2019t a money grab but to discourage use, so under that premise we should be giving that money back,\u201d Strecker told council.<\/p>\n<p class=\"STND-STND BodyText\">But he added that refunding the money requires that the tax rate be reduced and that doesn\u2019t meet the city\u2019s goal of curbing tobacco use.<\/p>\n<p class=\"STND-STND BodyText\">Mayor Steve Skadron, along with his four fellow elected officials, said he supports asking voters to allow the city to spend the money on education for addiction and other health and human services causes.<\/p>\n<p class=\"STND-STND BodyText\">\u201cI support going to the voters and explain why we are doing it,\u201d he said.<\/p>\n<p class=\"STND-STND BodyText\">The tax on tobacco was approved by <a id=\"N0x1199680N0x117d5a0:N0x1199680N0x11b57c0\" href=\"https:\/\/www.aspentimes.com\/news\/tobacco-tax-question-ok\/\">voters in 2017<\/a> on the condition that the maximum revenue collected \u2014 $325,000 \u2014 be used for financing health and human services, tobacco-related health issues and addiction and substance abuse education.<\/p>\n<p class=\"STND-STND BodyText\">The purpose of the tax was to push the price of tobacco products by a substantial amount so it would be too costly for younger consumers to obtain.<\/p>\n<p class=\"STND-STND BodyText\">Council in 2017 also changed the legal age to buy cigarettes from 18 to 21 years old.
