But things became particularly heated this week when a small tweak to U.S. copyright rules \u2014 which actually happened a whole year ago and is resurfacing now because of a new development \u2014 set off a chain of public accusations among streaming companies, songwriters and music business associations.<\/p>\n<p>It\u2019s a complicated matter that centers around a <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2019-02-05\/pdf\/2019-00249.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">densely formatted 119-page court document<\/a>, so here\u2019s a simplified rundown of the ruckus.<\/p>\n<p><strong>What is the issue?<\/strong><br \/>In January 2018, the U.S. Copyright Royalty Board, a three-judge panel that determines digital music payment rates, raised the amount of money that services like <a href=\"https:\/\/www.rollingstone.com\/t\/spotify\/\" id=\"auto-tag_spotify\" data-tag=\"spotify\">Spotify<\/a> have to pay to songwriters \u2014 from 10 percent of revenue to 15 percent of revenue over a five-year period, which is a significant increase that took a long time to negotiate and that the National Music Publishers Association hailed as \u201cthe biggest rate increase granted in CRB history.\u201d<\/p>\n<p><strong>So why is everyone so angry now?<br \/><\/strong>Last week, several streaming services (Amazon, Google\/YouTube, Pandora and Spotify) announced they will appeal the ruling, saying they believe the rate hikes will do more harm than good for the <a href=\"https:\/\/www.rollingstone.com\/t\/music-industry\/\" id=\"auto-tag_music-industry\" data-tag=\"music-industry\">music industry<\/a> They\u2019re proposing a different model for payouts that is less \u201ceconomically unsound.\u201d While CRB appeals are not uncommon \u2014 creators and distributors often quibble over how much money the other is owed \u2014 several songwriters like hitmaker Justin Tranter called the move \u201cshameful,\u201d and the NMPA lashed out at the streaming services for trying to \u201csue songwriters\u201d and cheat them out of money.<\/p>\n<p><strong>Is Spotify actually suing songwriters?<\/strong><br \/>No \u2014 and Spotify has taken care to clarify this itself in a <a href=\"https:\/\/artists.spotify.com\/blog\/you-might-have-heard-about-the-streaming-industry%27s-crb-appeal-here%27s-what\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">blog post<\/a>, writing that its issue is with the new rates set out in the CRB\u2019s decision. While \u201cit\u2019s natural for everyone to want a bigger piece of [the revenue] pie,\u201d Spotify said, the rates that the CRB has decided upon make it too difficult to offer discounted bundles, which are essential for getting new customers onto music-streaming services.<\/p>\n<p><strong>Why is <a href=\"https:\/\/www.rollingstone.com\/t\/apple\/\" id=\"auto-tag_apple\" data-tag=\"apple\">Apple<\/a> Music involved<\/strong><strong>?<\/strong><br \/>Apple is the only major music-streaming service not involved in the appeal. It took advantage of that position by releasing a lengthy statement on Friday saying that Spotify <em>is<\/em> suing music creators while Apple Music is pro-artist because it accepts the CRB\u2019s current plan for higher rates. \u201cThis isn\u2019t just wrong, it represents a real, meaningful and damaging step backwards for the music industry,\u201d Apple said in its own <a href=\"https:\/\/www.apple.com\/newsroom\/2019\/03\/addressing-spotifys-claims\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">blog post<\/a>. \u201cUnderneath the rhetoric, Spotify\u2019s aim is to make more money off others\u2019 work.\u201d Apple had another motive for publicly pointing fingers at Spotify: It is currently waging an <a href=\"https:\/\/www.musicbusinessworldwide.com\/spotify-files-anti-trust-complaint-against-apple-over-app-tax-in-eu\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">entirely separate court battle<\/a> with the Swedish streaming service over the 30 percent commission it takes for in-app purchases made via the iOS App Store.<\/p>\n<p><strong>And what now?<br \/><\/strong>The four streaming services standing against the CRB\u2019s new rate will now bring their appeal forward to the U.S. Court of Appeals for the D.C. Circuit, and the case could take years to resolve. Some industry analysts are proposing everybody-wins solutions such as getting listeners to <a href=\"http:\/\/www.midiaresearch.com\/blog\/heres-how-spotify-can-fix-its-songwriter-woes-hint-its-all-about-pricing\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">pay more<\/a> for monthly streaming subscriptions, which would deliver more money to songwriters and streaming companies alike. But nothing indicates that \u2014 or anything else \u2014 will happen anytime soon.
