Marshmello<\/a> is facing a lawsuit from a fellow EDM producer, Russian DJ Arty, over alleged similarities between their respective songs. In a complaint filed Monday in California federal court, Arty (Artem Stoliarov) accuses the writers of \u201cHappier,\u201d Marshmello\u2019s hit collaboration with Bastille<\/a>, of \u201cwillfully copying\u201d his remix of OneRepublic<\/a>\u2019s \u201cI Lived,\u201d The Hollywood Reporter<\/em><\/a> notes. <\/span><\/p>\n

The complaint<\/a> is unique given its focus on a remix. Arty specifically targets the songwriters \u2014 Marshmello (Christopher Comstock), Bastille frontman Daniel Campbell Smith and producer Steve Mac \u2014 for allegedly borrowing the \u201coriginal composition elements\u201d of the revamped track \u201cnote for note,\u201d including a repeating synthesizer pattern. Several music publishing companies are also named as defendants in the suit.<\/span><\/p>\n

Nashville copyright attorney Richard Busch, who previously represented the Marvin Gaye estate in its suit against Robin Thicke and Pharrell Williams\u2019 \u201cBlurred Lines,\u201d is representing Arty. The DJ<\/span> is seeking \u201cactual damages in addition to Defendants\u2019 profits both domestically and relating to foreign sales of other exploitation of \u2018Happier\u2019 that were manufactured, distributed or otherwise infringed domestically,\u201d along with a \u201crunning royalty on all future exploitations of \u2018Happier\u2019 following judgement in an amount to be determined.\u201d<\/span><\/p>\n

\u201cEverything we have to say at this time is set forth in detail in the Complaint,\u201d a representative for Arty tells Rolling Stone<\/em>. \u201cThis includes of course the facts setting forth, among other things, access, and a thorough and compelling musical transcription comparison that shows, as we said in the Complaint, note for note copying of Arty\u2019s work.\u201d<\/span><\/p>\n

A rep for Marshmello did not immediately respond to a request for comment.<\/span><\/p>\n

Marshmello and Bastille released \u201cHappier\u201d in August 2018. The song eventually went double-platinum, peaking at Number Two on the UK Singles Chart and Billboard Hot 100 \u2014 a career best for both. OneRepublic issued the original version of \u201cI Lived\u201d on their third LP, 2013\u2019s Native<\/em>, with Arty\u2019s remix out the following year.<\/span><\/p>\n
