BodyText\">The ramifications of the city of Aspen\u2019s land-use code is having a chilling effect on how the Wheeler Opera House can operate this summer, effectively prohibiting the historic establishment from replacing its air conditioning equipment on the roof.<\/p>\n<p class=\"STND-STND BodyText\">Last year, Wheeler Executive Director Gena Buhler thought she had found a fix to the failing \u201cchiller\u201d on the opera house\u2019s roof.<\/p>\n<p class=\"STND-STND BodyText\">It had been malfunctioning even with new parts, resulting in no air conditioning last fall for the art gallery, restaurant and opera house that are housed in the city-owned building.<\/p>\n<p class=\"STND-STND BodyText\">\u201cWe cannot not have air conditioning,\u201d Buhler said of the performance space that brings in thousands of people, as well as the commercial operations that help fund area arts nonprofits.<\/p>\n<p class=\"STND-STND BodyText\">So when the temporary fixes no longer worked, she and her team decided to replace the entire piece of air conditioning equipment.<\/p>\n<p class=\"STND-STND BodyText\">The old one went to the landfill and the new one, which is a bit smaller, went on the roof.<\/p>\n<p class=\"STND-STND BodyText\">The city\u2019s Community Development Department, however, flagged the mechanical permit that had been submitted because it doesn\u2019t comply with the land-use code that was <a id=\"N0x19e2a80N0x1aea3d0:N0x19e2a80N0x1b56b50\" href=\"https:\/\/www.aspentimes.com\/news\/land-use-changes-back-before-city-council-on-monday-jan-9\/\">rewritten<\/a> and approved by Aspen City Council in 2017.<\/p>\n<p class=\"STND-STND BodyText\">\u201cUnfortunately, the law that was passed by council \u2026 we can\u2019t replace any piece of equipment on the roof because it affects the mountain viewplane from (the Hotel Jerome),\u201d Buhler said.<\/p>\n<p class=\"STND-STND BodyText\">And that goes for any building in any of the <a id=\"N0x19e2a80N0x1aea490:N0x19e2a80N0x1b56d00\" href=\"https:\/\/www.cityofaspen.com\/DocumentCenter\/View\/135\/Title-26---Part-400-Development-Review-Standards-and-Procedures-PDF?bidId=\">seven viewplanes<\/a> around town.<\/p>\n<p class=\"STND-STND BodyText\">Jessica Garrow, the city\u2019s Community Development director, said council and staff spent the most time on this section of the <a id=\"N0x19e2a80N0x1aea4f0:N0x19e2a80N0x1b56e20\" href=\"https:\/\/www.aspentimes.com\/news\/city-to-hire-consultants-for-land-use-code-revision\/\">reworked<\/a> land-use code.<\/p>\n<p class=\"STND-STND BodyText\">The new law is an attempt to make all reviews and rules applied the same way in each viewplane, she noted.<\/p>\n<p class=\"STND-STND BodyText\">\u201cWe want to make sure the viewplanes are <a id=\"N0x19e2a80N0x1aea550:N0x19e2a80N0x1b56fd0\" href=\"https:\/\/www.aspentimes.com\/news\/how-2012-shaped-the-city-of-aspens-moratorium-strategy\/\">preserved<\/a>,\u201d Garrow said. \u201cWe are making sure that everyone\u2019s playing by the rules.\u201d<\/p>\n<p class=\"STND-STND BodyText\">Buhler learned quickly that the city is not exempt from its own rules.<\/p>\n<p class=\"STND-STND BodyText\">\u201cIt\u2019s a level of bureaucracy that could potentially have a community impact,\u201d she said, adding that she and other municipal government officials didn\u2019t expect to run into this type of problem, especially since the old chiller is now buried in the landfill. \u201cThis is a huge awakening to us, and we are the city.\u201d<\/p>\n<p class=\"STND-STND BodyText\">The city has given the Wheeler a temporary permit to use the new chiller this summer.<\/p>\n<p class=\"STND-STND BodyText\">\u201cThis is a unique situation because it\u2019s an emergency,\u201d Garrow said.<\/p>\n<p class=\"STND-STND BodyText\">But Buhler will likely have to go before the Historic Preservation Commission for review on the replacement equipment.<\/p>\n<p class=\"STND-STND BodyText\">\u201cWe are hoping that they will look at the law in place and see that it has more of a negative impact than what was intended,\u201d Buhler said. \u201cWe are begging for forgiveness.\u201d<\/p>\n<p class=\"STND-STND BodyText\">Garrow said that per the code, the city will first review the permit administratively and through a viewplane survey, and if doesn\u2019t meet current requirements, it will have to go to HPC.<\/p>\n<p class=\"STND-STND BodyText\">Buhler said she appreciates the Community Development Department working with the Wheeler to find a solution.<\/p>\n<p class=\"STND-STND BodyText\">She added that she hopes HPC understands the severity of the situation for the success of a community historic asset.<\/p>\n<p class=\"STND-STND BodyText\">\u201cIt\u2019s been a little stressful,\u201d she said. \u201cAt the end of the day, the Wheeler needs to be air conditioned.\u201d<\/p>\n<p class=\"STND-STND BodyText
