{"id":2444378,"date":"2019-05-19T21:00:00","date_gmt":"2019-05-20T03:00:00","guid":{"rendered":"https:\/\/www.aspentimes.com\/?p=306173"},"modified":"2019-05-19T21:00:00","modified_gmt":"2019-05-20T03:00:00","slug":"aspens-electeds-reconsider-full-flavored-nicotine-ban","status":"publish","type":"post","link":"https:\/\/alwaysmountaintime.com\/kspn\/local-news\/aspens-electeds-reconsider-full-flavored-nicotine-ban\/","title":{"rendered":"Aspen\u2019s electeds reconsider full flavored nicotine ban"},"content":{"rendered":"<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"620\" height=\"413\" src=\"https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2019\/05\/HTTobaccoVideo-GVU-0828181.jpg\" class=\"attachment-large size-large wp-post-image\" alt srcset=\"https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2019\/05\/HTTobaccoVideo-GVU-0828181.jpg 620w, https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2019\/05\/HTTobaccoVideo-GVU-0828181-300x200.jpg 300w\" sizes=\"auto, (max-width: 620px) 100vw, 620px\"><\/figure>\n<p class=\"STND-STND BodyText\">A majority of Aspen\u2019s elected officials are leaning away from a proposed ban on all flavored tobacco products within city limits, and instead will consider a partial prohibition tonight.<\/p>\n<p class=\"STND-STND BodyText\">After hearing from Local\u2019s Corner convenience store owner Mike Haisfield at last week\u2019s meeting about how much a full ban would affect his bottom line and other arguments, Aspen City Council members said they would reconsider the ordinance that was presented to them at first reading May 13.<\/p>\n<p class=\"STND-STND BodyText\">After debate and presentations from public health officials during a <a id=\"N0x1ca0c10N0x1c12140:N0x1ca0c10N0x1e20b40\" href=\"https:\/\/www.aspentimes.com\/news\/local\/aspen-moving-forward-with-ban-on-all-flavored-nicotine-products\/\">May 6 work session<\/a>, council directed staff to draft an ordinance that would ban all flavored tobacco and vaporizing products in Aspen.<\/p>\n<p class=\"STND-STND BodyText\">Council also had asked for staff to check in with retailers that sell flavored nicotine products to get their feedback on the potential full ban.<\/p>\n<p class=\"STND-STND BodyText\">CJ Oliver, the city\u2019s environmental health and sustainability director, reported there was significant resistance from local businesses whose sales would be impacted.<\/p>\n<p class=\"STND-STND BodyText\">Retailers said the city\u2019s <a id=\"N0x1ca0c10N0x1c121a0:N0x1ca0c10N0x1e20d80\" href=\"https:\/\/www.aspentimes.com\/news\/local\/aspen-to-ask-voters-this-fall-to-keep-excess-tobacco-tax-revenue\/\">$3 tax on cigarettes<\/a> and changing the legal age to buy tobacco and nicotine products to 21 have curbed sales, and the goal to limit access to teens has been met.<\/p>\n<p class=\"STND-STND BodyText\">Despite retailers\u2019 resistance, the majority of council wanted to press on with a full ban.<\/p>\n<p class=\"STND-STND BodyText\">Councilman Adam Frisch was in the minority at that meeting but appeared to have gained support during first reading last week.<\/p>\n<p class=\"STND-STND BodyText\">Frisch said if it\u2019s about youth, then a ban is effective. But prohibiting flavored nicotine from adults is government overreach, he said.<\/p>\n<p class=\"STND-STND BodyText\">A father of two sons in Aspen High School, Haisfield told council last week that he stopped selling flavored vape pens and e-cigarettes in December 2017 as a way to curb youth from getting their hands on the products.<\/p>\n<p class=\"STND-STND BodyText\">But menthol cigarettes and flavored chewing tobacco are not what area kids are going for, so a full ban would only hurt his bottom line.<\/p>\n<p class=\"STND-STND BodyText\">Haisfield estimated that he would lose between 20 and 25 percent of sales as a result of the full ban.<\/p>\n<p class=\"STND-STND BodyText\">He said he lost about 35 percent of sales in 2018 after the age to buy nicotine products went from 18 to 21, and the tax went into effect. He said he is another 10 percent down this year.<\/p>\n<p class=\"STND-STND BodyText\">\u201cI feel like the issue is the youth, and I think when they are 21 they can make their own decision,\u201d Haisfield told council, adding the ban wouldn\u2019t apply in Pitkin County, where it\u2019s available at the Conoco at the Aspen Business Center. \u201cA ban won\u2019t stop a young adult from actually trying a product, especially when it\u2019s a car ride 3.6 miles away at the airport.\u201d<\/p>\n<p class=\"STND-STND BodyText\">His sons, Brady and Jon, a freshman and junior at high school, respectively, also spoke in front of council.<\/p>\n<p class=\"STND-STND BodyText\">They said their peers are not looking for tobacco products, but vaping is prevalent in the school.<\/p>\n<p class=\"STND-STND BodyText\">\u201cFrom a student\u2019s perspective \u2026 you never see students chewing or dipping or anything else with tobacco,\u201d Jon Haisfield said.<\/p>\n<p class=\"STND-STND BodyText\">A majority of council at the May 13 meeting appeared to be swayed enough to only eliminate flavored vaporizing and electronic nicotine products.<\/p>\n<p class=\"STND-STND BodyText\">\u201cI still have trepidation and concerns telling someone over 21 what do with their life,\u201d Councilman Ward Hauenstein said.<\/p>\n<p class=\"STND-STND BodyText\">Councilman Bert Myrin concurred.<\/p>\n<p class=\"STND-STND BodyText\">\u201cPeople over 21 should be able to do whatever they want to do without impacting others,\u201d he said.<\/p>\n<p class=\"STND-STND BodyText\">Mayor Steve Skadron said while it\u2019s council\u2019s job to protect the public health and safety of the community, he said he is swayed that a full ban won\u2019t be effective due to the close proximity of having flavored tobacco products in neighboring communities.<\/p>\n<p class=\"STND-STND BodyText\">Councilwoman Ann Mullins reminded her colleagues that they\u2019ve been presented with compelling evidence from public health officials that a full ban is effective in deterring use.<\/p>\n<p class=\"STND-STND BodyText\">Council will discuss the matter at its regular meeting which begins at 5 p.m. today in City Hall.<\/p>\n<p class=\"STND-STND BodyText Tagline\"><a href=\"mailto:csackariason@aspentimes.com\">csackariason@aspentimes.com<\/a><\/p>\n<p><a href=\"https:\/\/www.aspentimes.com\/news\/local\/aspens-electeds-reconsider-full-flavored-nicotine-ban\/\" target=\"_blank\" rel=\"noopener noreferrer\">via:: The Aspen Times<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A majority of Aspen\u2019s elected officials are leaning away from a proposed ban on all flavored tobacco products within city limits, and instead will consider a partial prohibition tonight.
