The defendant has lost at every turn \u2014 including the state district and appellate court levels, as well as failing to persuade both the state and United States supreme courts to hear the case.<\/p>\n<p class=\"STND-STND BodyText\">Pitkin County District Court Judge Chris Seldin delivered his order that Mulcahy sell his residence in 2016; however, enforcement of the ruling has been stalled due to lingering legal issues. In June, <a id=\"N0x18b77a0N0x1a5b680:N0x18b77a0N0x18c76d8\" href=\"https:\/\/www.aspentimes.com\/news\/local\/district-judge-again-rules-against-aspen-man-trying-to-keep-his-house\/\">Seldin ruled the order now stands<\/a> and can be enforced.<\/p>\n<p class=\"STND-STND BodyText\">According to a motion APCHA filed last week, Mulcahy ignored the Housing Authority\u2019s request June 24 that he prepare a listing contract and for the home \u2014 which has a maximum sales price of $995,000.<\/p>\n<p class=\"STND-STND BodyText\">\u201cThis constitutes a violation of the judgment of this Court,\u201d the motion says.<\/p>\n<p class=\"STND-STND BodyText\">Mulcahy and his mother, Sandy, complained to Aspen City Council about APCHA\u2019s proposed receivership, which they characterized as the transfer of title through a third party.<\/p>\n<p class=\"STND-STND BodyText\">\u201cThey have the power and authority to come to our home and say you are trespassing,\u201d she said. \u201cThat could mean Tasing us because I am not leaving. I\u2019m 83 and I feel like I have led a good life.\u201d<\/p>\n<p class=\"STND-STND BodyText\">The older Mulcahy also said, \u201cThis lady is not going to leave.\u201d<\/p>\n<p class=\"STND-STND BodyText\">Lee Mulcahy said APCHA\u2019s process of notifying him he was in violation was illegal and without due process. He said he is ready to show compliance that he works 1,500 hours a year as an artist at any time.<\/p>\n<p class=\"STND-STND BodyText\">\u201cOur constitutional rights have been stomped on,\u201d he said.<\/p>\n<p class=\"STND-STND BodyText\">The motion notes Mulcahy can continue to inhabit the residence, located on Forge Road in the Burlingame Ranch affordable-housing development, until the sale of the home closes.
