The suit, filed on Wednesday, claims that Spotify has no license to stream hundreds of the rapper\u2019s songs.<\/p>\n<p>Among the estimated 250 songs in question are several of Eminem\u2019s massive hits. The suit claims that though Eminem\u2019s songs have streamed billions of times on Spotify, \u201cSpotify has not accounted to Eight Mile or paid Eight Mile for these streams but instead remitted random payments of some sort, which only purport to account for a fraction of these streams.\u201d<\/p>\n<p>The complaint cites \u201cLose Yourself,\u201d which the plaintiff alleges was placed in a category called \u201cCopyright Control,\u201d where songs are relegated when the owner is unknown. The lawsuit claims it is \u201cabsurd\u201d that Spotify would not be able to identify the song\u2019s owner as it\u2019s \u201cone of the most well-known songs in history.\u201d The 2002 <em>8 Mile<\/em> track peaked at Number One on the Billboard Hot 100 chart and also won the Academy Award for Best Original Song.<\/p>\n<p>The lawsuit also targets the <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/trump-signs-music-modernization-act-736185\/\">Music Modernization Act<\/a> (MMA), and claims that Spotify was not compliant with the new law, which was intended to update copyright rules for the digital and streaming era and aid music creators in receiving royalties due. The suit alleges that Spotify \u201cdidn\u2019t engage in the required commercially reasonable effort to match sound recordings with the Eight Mile compositions as required by the MMA.\u201d<\/p>\n<p>A rep for Spotify did not immediately respond to <em>Rolling Stone<\/em>\u2018s request for comment.<\/p>\n<p>The complaint additionally questions the constitutionality of aspects of the MMA. \u201cThe MMA\u2019s retroactive elimination of the right of a plaintiff to receive profits attributable to infringement, statutory damages, and attorneys\u2019 fees, is an unconstitutional denial of due process (both procedural and substantive), and an unconstitutional taking of vested property rights,\u201d the complaint alleges.<\/p>\n<p> <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/eminem-publisher-spotify-copyright-infringement-lawsuit-874956\/\" target=\"_blank\" rel=\"noopener noreferrer\">via:: Rolling Stone<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Eminem\u2019s publishing company, Eight Mile Style, has filed a copyright infringement suit against Spotify, The Hollywood Reporter reports.
