Should She?"},"content":{"rendered":"<div><img decoding=\"async\" src=\"https:\/\/www.rollingstone.com\/wp-content\/uploads\/2019\/08\/10359323cs.jpg\" class=\"ff-og-image-inserted\"><\/div>\n<p class=\"p1\"><span class=\"s1\">When Scooter Braun\u2019s $300 million deal to acquire Scott Borchetta\u2019s Big Machine Label Group was announced in late June, <a href=\"https:\/\/www.rollingstone.com\/t\/taylor-swift\/\" id=\"auto-tag_taylor-swift\" data-tag=\"taylor-swift\">Taylor Swift<\/a> made no secret of her dismay. She had been the label\u2019s biggest draw for 13 years while simultaneously feuding with one of Braun\u2019s off-and-on clients, Kanye West. Swift <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/taylor-swift-scooter-braun-big-machine-worst-case-scenario-853836\/\">wrote in a lengthy Tumblr post<\/a> how the deal felt like a massive betrayal, especially since this meant Braun would now own her masters.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Swift has found the perfect revenge, however, <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/taylor-swift-absolutely-plans-to-re-record-catalog-after-big-machine-deal-874173\/\">announcing in an interview with <em>CBS This Morning<\/em><\/a> that she intends to re-record her first six albums. During an <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/taylor-swift-lover-good-morning-america-874982\/\">appearance on <em>Good Morning America<\/em><\/a>, she&nbsp;further revealed that she can begin recording after November 2020, presumably following the expiration of her contracts with Big Machine. But many have wondered if&nbsp;it\u2019d truly be feasible, or advisable, for Swift to re-record all the albums, especially since her first six albums already exist&nbsp;on streaming services and continue to rake in large numbers.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Swift\u2019s comment about preparing for action in 2020 suggests that there are contract terms for her to wait out \u2014 but it\u2019s yet unclear what the specific terms in her case are. \u201cRecording agreements almost always restrict artists from re-recording musical compositions embodied on the label\u2019s recordings for a number of years after the expiration of the recording agreement,\u201d music attorney Rachel Stilwell tells <em>Rolling Stone<\/em>. \u201cBut not all re-record restrictions are cut from the same cloth, and we don\u2019t know what\u2019s in Swift\u2019s prior agreement with Big Machine.\u201d (A rep for Swift declined to comment for this story. A rep for Big Machine did not return a request for comment.)<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Stilwell says many contracts state that re-recording those songs is prohibited until \u201cthe later of two years following the expiration of the agreement or five years after the commercial release.\u201d If that common language were present in Swift\u2019s contract, the only album that will not be fair game in the near future will be 2017\u2019s <em>Reputation<\/em>. Everything up to her 2014 album <em>1989<\/em>&nbsp;could be re-released by Swift either independently or through her new deal with Republic and Universal in late 2020.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">\u201cWhile an aggressive re-recording effort would be driven by principle, not money, there are nonetheless still economic considerations,\u201d music lawyer James Sammataro tells&nbsp;<em>Rolling Stone.<\/em> \u201cThere is the cost of production \u2014 admittedly, a drop in the bucket. But, if Swift were to create identical versions of her earlier works, she\u2019s essentially competing against herself, having two identical works vying for the same listeners.\u201d<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">According to <a href=\"https:\/\/amp.tmz.com\/2019\/08\/21\/taylor-swift-plans-rerecord-masters-scooter-braun-purchase-big-machine\/?__twitter_impression=true\" rel=\"nofollow noopener noreferrer\" target=\"_blank\"><span class=\"s2\">TMZ<\/span><\/a>, however, Swift may have another roadblock: an \u201coriginal production clause,\u201d under which&nbsp;Swift would be unable to directly copy the original versions of the Big Machine songs. Stilwell states that such a clause is common in many contracts.&nbsp;<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Other than any language or clauses that may affect how she produces her new recordings, Swift has been the primary writer since her debut self-titled album, meaning that copyrights on the publishing side of things won\u2019t be difficult. According to an industry insider, she will not have to ask for permission from co-writers and producers like Liz Rose and Nathan Chapman. She will, however, need to pay a licensing fee.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Even if she did need to ask for permission, many of her early collaborators are expressing enthusiasm in her decision to regain ownership of her music.<\/span> <span class=\"s1\">\u201cI think it\u2019s fantastic,\u201d Robert Ellis Orrall, who co-wrote the song \u201cA Perfect World\u201d on Swift\u2019s debut album, tells <em>Rolling Stone<\/em>. \u201cI hope she adds bonus tracks; her fans are very vocal about favorite unreleased songs.
