In defiance of a cease and desist order Shooter\u2019s owner Lauren Boebert opened her business to customers outside of her Third Street business on May 14.<\/strong><br \/><em>Kyle Mills\/Glenwood Springs Post Independent<\/em><\/figcaption><\/div>\n<\/figure>\n<p>Attorneys for Garfield County and the owner of Shooters Grill in Rifle are in talks to reinstate the restaurant\u2019s food service license, but the matter is no longer before the courts.<\/p>\n<p>The county on Tuesday moved to dismiss the temporary restraining order against Shooters that was filed May 13. However, the license suspension that occurred two days later remains in effect, Garfield County Attorney Tari Williams said.<\/p>\n<p>\u201cIt was not necessary to proceed with the hearing \u2026 due to the variance approval and the new [governor\u2019s] executive order,\u201d Williams said of the latest actions by the state allowing restaurants to reopen at 50% capacity.<\/p>\n<p>Shooters owner Lauren Boebert was&nbsp;<a href=\"https:\/\/www.postindependent.com\/news\/in-continued-defiance-of-health-orders-shooters-grill-takes-dining-outside\/\" target=\"_blank\" rel=\"noopener noreferrer\">cited<\/a>&nbsp;for operating against public health orders when she reopened to in-restaurant dining May 9, in open defiance of the rules aimed at controlling the spread of COVID-19 in Colorado.<\/p>\n<div class=\"row\">\n<div class=\"col\" readability=\"6\">\n<div class=\"row at-donation at-donation-mobile p-0\" readability=\"7\">\n<div class=\"col-xl-4 p-2\">\n<div data-bg=\"url(https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2020\/03\/AT-logo-white.png)\" class=\"p-0 mt-2 mb-2 h-75 text-center rocket-lazyload\">\n<p><img decoding=\"async\" src=\"https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2020\/03\/AT-logo-white.png\" class=\"logo m-0 p-0 invisible\"><\/p>\n<\/div>\n<\/div>\n<p><h3 class=\"d-inline mr-3\">Support Local Journalism<\/h3>\n<p><button class=\"btn d-inline\" type=\"button\" onclick=\"handleDonationButtonClickMidArticle()\">Donate<\/button><\/p>\n<\/div>\n<p><\/div>\n<\/div>\n<p>When Boebert continued to serve customers on site, including setting up an outdoors dining area, the county&nbsp;<a href=\"https:\/\/www.aspentimes.com\/news\/local\/shooters-restaurant-license-suspended-ahead-of-court-hearing\/\">suspended<\/a>&nbsp;her restaurant license. The district court action regarding the restraining order was separate from the license suspension.<\/p>\n<p>Her hearing was&nbsp;<a href=\"https:\/\/www.aspentimes.com\/news\/regional\/shooters-grill-injunction-hearing-continued-to-allow-owner-lauren-boebert-to-retain-legal-counsel\/\">continued<\/a>&nbsp;from May 18 until Tuesday morning, until the county\u2019s motion was filed and Boebert agreed to have the case dropped.<\/p>\n<p>\u201cIt would not have been appropriate to discuss holding her to an inapplicable standard,\u201d Williams said of the reasoning for vacating the court action.<\/p>\n<p>In the meantime, the County Attorney\u2019s Office is working with legal counsel for Boebert to reopen the restaurant in accordance with the county\u2019s variance and the state\u2019s relaxed rules, Williams said.<\/p>\n<p>\u201cWhen her license is reinstated, she will be expected to comply with the terms of new orders, just like every other restaurant in the county,\u201d Williams said. \u201cThat is still in the works.\u201d<\/p>\n<p><em><a href=\"mailto:jstroud@postindependent.com\" target=\"_blank\" rel=\"noopener noreferrer\">jstroud@postindependent.com<\/a><\/em><\/p>\n<\/div>\n<div readability=\"11.303082191781\">\n<div class=\"col-xl-7 pt-3 pb-4 at-4 pl-4\" readability=\"19.164371772806\">\n<p><img decoding=\"async\" src=\"https:\/\/cdn.aspentimes.com\/wp-content\/uploads\/sites\/5\/2020\/03\/AT-logo-white.png\" class=\"logo\"><\/p>\n<p><strong>Readers around Aspen and Snowmass Village make the Aspen Times\u2019 work possible.
