A woman was charged with felony assault on a peace officer Monday night after a traffic stop on U.S. Highway 40 in Grand County.
According to the arrest report, officers with the sheriff’s office responded to a report of a drunk driver Monday night and one of the deputies passed a dark colored truck matching the description on U.S. Highway 40 in Hot Sulphur Springs.
The deputy turned around and, as he was catching up to the truck, noticed the driver was weaving all over the road, the report says.
The deputy stopped the truck at Aspen Street in Hot Sulphur Springs. Upon approaching the truck, the deputy found Jana Y. Raines, 48, behind the wheel and she was the only one inside. The officer reportedly asked Raines if she had been drinking and she told him she had not.
The arrest report continues by saying Raines struggled to produce her ID, proof of insurance and registration during the stop, and a sergeant with the sheriff’s office had to help her find those items.
When the sergeant asked Raines where she was headed, she reportedly told him she was on her way home to Golden and thought she was in Lyons.
After being asked to step out of the truck, Raines opened her door and officers reported she smelled of alcohol, had glassy eyes and slurred speech. Raines was also allegedly unsteady on her feet.
After that, Raines agreed to roadside sobriety tests, during which she struggled to follow directions, according to the report. The officers then arrested Raines for DUI and put her in handcuffs. However, when the deputy began to walk her over to his patrol truck, she pulled away from the deputy. The report says the sergeant and another sheriff’s deputy stepped in to help by grabbing Raines’ other arm.
“At this point, Raines placed a foot up on the side of my patrol truck and began pushing away,” the deputy wrote before adding that he then grabbed Raines’ leg that was up against his truck, as the sergeant tried to control her from the other side.
“At that point, she collapsed due to her non-compliance and lack of balance and (the sergeant) fell to the ground with Raines,” the deputy continued.
The officers helped Raines to her feet again and tried to get her in the patrol truck. However, Raines reportedly refused and kicked one deputy twice in the abdomen and then tried to kick him again in the groin.
The report adds the sergeant tried to avoid having to tow Raines’ truck by offering to move it to a nearby parking spot, but she “was belligerent and refused to comply.”
Once at the Grand County Jail, Raines submitted to a breath test, which found her blood-alcohol content to be almost three times the legal limit. She was then booked into the jail on charges of felony assault on a peace officer, DUI, obstructing a peace officer, open container, speeding, weaving and resisting arrest. According to the jail log, Raines was released the following day.
